By accessing or using Transcend Messenger ("the Service"), operated by Recurve Labs ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Transcend Messenger is a messaging application that provides:

Real-time messaging between users (direct messages and group chats)
End-to-end encryption for message privacy
AI-powered message translation
AI assistant for answering questions within chats
AI-powered image generation
Media sharing (photos, videos, voice messages, GIFs)
Contact management

3. User Accounts

To use the Service, you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Be responsible for all activities under your account

You must be at least 13 years old to use this Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. Acceptable Use

6. End-to-End Encryption

Messages sent through Transcend Messenger are protected with end-to-end encryption. This means:

Only you and your recipients can read your messages
We cannot access the content of your encrypted messages
You are responsible for keeping your encryption keys and account password secure
If you lose access to your encryption keys, messages cannot be recovered
We are not responsible for data loss resulting from lost encryption keys

7. AI Features

The Service includes AI-powered features including translation, chat assistant, and image generation. Please note:

AI outputs are generated automatically and may contain errors or inaccuracies
Translations are approximate and should be verified for critical communications
AI-generated images are created using third-party AI services and are subject to their content policies
You are responsible for how you use AI-generated content
We do not guarantee the accuracy, appropriateness, or legality of AI-generated content
AI features may be subject to usage limits based on your subscription plan
We reserve the right to refuse AI requests that violate content policies

8. Subscriptions and Payments

Some features require a paid subscription. By subscribing:

You authorize us to charge your payment method on a recurring basis
Subscriptions automatically renew unless canceled before the renewal date
You can cancel your subscription at any time through your account settings or the Stripe billing portal
Refunds are handled on a case-by-case basis at our discretion
Prices may change with notice; continued use constitutes acceptance
We use Stripe for payment processing; your payment information is handled according to Stripe's terms and privacy policy

9. User Content

You retain ownership of content you create and share through the Service. By using the Service, you grant us a limited license to transmit and store your content as necessary to provide the Service. You are solely responsible for:

The content you share, including messages, media, and AI-generated content
Ensuring you have the right to share any content you upload
Any consequences resulting from sharing your content

10. Intellectual Property

The Service and its original content, features, and functionality are owned by Recurve Labs and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written consent.

11. Third-Party Services

The Service integrates with third-party services including but not limited to:

AI providers for translation, chat, and image generation
Stripe for payment processing
Cloud infrastructure providers for hosting and storage

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including but not limited to violations of these Terms. You may delete your account at any time through the app settings. Upon termination:

Your right to use the Service will immediately cease
Your data will be deleted according to our data retention policy
Any unused subscription period will not be refunded unless required by law

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

14. Limitation of Liability

To the maximum extent permitted by law, Recurve Labs and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

Your use or inability to use the Service
Any unauthorized access to or use of our servers or your data
Any interruption or cessation of transmission to or from the Service
Any errors or inaccuracies in AI-generated content
Any content or conduct of any third party on the Service

15. Indemnification

You agree to indemnify, defend, and hold harmless Recurve Labs and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
